Over the past few weeks the Clerk's Office has noticed an increase in documents being sent to the Clerk's Office that appear to be an attempt to file a proof of claim. Unrepresented (pro se) creditors have been sending the Clerk's Office the original 341 notice with just an invoice enclosed (such as invoices from doctor offices and other businesses) but have not sent a completed proof of claim form. Without the proof of claim form, if the document is not clearly marked as proof of claim, the Clerk's Office is uncertain what the intent was in sending us the documents.

In an effort to be sure we provide pro se creditors with every opportunity to file a proof of claim and to provide notification to trustees that a pro se creditor may have intended to file a proof of claim, the clerk's office will, upon receipt of the document:

Scan and file the document on the Case Docket as Bankruptcy > Court Events > Undesignated Document. (You can search this event by doing a "Flags" report or by running a "Docket Activty" report)

Please note that these types of documents will not appear on the claims register.
