Conference Approves Fee Increase

In September 2011, the Judicial Conference of the United States authorized an increase in the Judiciary's electronic public access fee in response to increasing costs for maintaining and enhancing the electronic public access system. The increase in the electronic public access (EPA) fee, from $.08 to $.10 per page, will take effect on April 1, 2012. The change is needed to continue to support and improve the Public Access to Court Electronic Records (PACER) system, and to develop and implement the next generation of the Judiciary's Case Management/Electronic Case Filing system.

The EPA fee has not been increased since 2005. As mandated by Congress, the EPA program is funded entirely through user fees set by the Conference.

The Conference was mindful of the impact such an increase could have on other public entities and on public users accessing the system to obtain information on a particular case. For this reason, local, state, and federal government agencies will be exempted from the increase for three years. Moreover, PACER users who do not accrue charges of more than $15 in a quarterly billing cycle would not be charged a fee. (The current exemption is $10 per quarter.) The expanded exemption means that 75 to 80 percent of all users will still pay no fees.



 Compensation of Witnesses

The statute, 28 U. S. C. 1821, establishes a $40.00 per day attendance fee for witnesses in courts of the United States and further entitles such witnesses to reimbursement of travel and subsistance expenses for the states listed on the per diem rates chart in the same amounts payable to federal government employees for official travel.

Effective for travel on or after January 21, 2002, judiciary travelers may claim mileage expenses as follows:

48.5 cents per mile for use of a privately-owned automobile;
28 cents per mile for use of a privately-owned motorcycle;
97.5 cents per mile for use of a privately-owned airplane.

Search of Records

If you need information regarding a particular case and you do not have the case number and you believe the individual filed for bankruptcy on or after August 1, 1992, information can be obtained by calling the voice case information system (VCIS) at 1-866-222-8029.

If the case was filed before August 1, 1992, you may search the master index file in our Utica office between the hours of 9:00 AM and 4:00 PM E.S.T. Or, you may submit your request for a search in writing with the fee of $30.00 per name or item you wish us to search.


Photocopies

The public may obtain copies of court documents in person or by written request.

In Person
The public may come to the court and print copies of electronic documents filed after December 28, 2002, from our public terminal at a cost of $.10 a page. The Clerk’s Office requires the exact amount and cannot make change.

Written Request
You may mail a written request and a photocopy fee of $.50 cents per page in the form of a check, travelers check or money order made payable to: Clerk, United States Bankruptcy Court. Please include the case name, case number, and the title of the documents which you wish to have photocopied. In addition, please include your name, address and telephone number. Mail your request to the Clerk's Office location where the case is pending with a self-addressed stamped envelope.

Obtaining Page Counts
If you wish to obtain photocopies of court documents, but do not know the number of pages, please call the appropriate number listed below. You will be prompted to leave your name and phone number, along with the case number, case name, and description of the document. A member of the Clerk’s Office will contact you with a page count and postage estimate for your self-addressed stamped envelope. The Clerk’s Office will not fax or e-mail copies to requesting parties.

NOTE: Copies of Case Documents Filed Prior to December 1, 2003

On September 14, 2010, the Judicial conference amended the policy on privacy and public access to electronic case files by restricting public access through the Public Access to Court Electronic Records (PACER) service to documents in bankruptcy cases that were filed before December 1, 2003, and have been closed for more than one year, with the following conditions:

1.   The docket sheet and docket information will remain available to the general public via PACER.
     
2,   Any party that has filed a notice of appearance in an individual case will have CM/ECF access to all filings in that case.
     
3.   All documents in such cases will remain accessible at the clerk's offices, except those under seal.
     
4.   Access to documents in bankruptcy case appeals filed in the district courts, bankruptcy appellate panels or courts of appeals for bankrutpcy cases filed in the bankruptcy court prior to December 1, 2003, will be similarly restricted.

Requests for copies of documents in restricted cases can be made in person at the public counter or by written request.


Rule 2013: Public Record of Compensation Awarded to Trustees, Examiners, and Professionals

A yearly summary of fees awarded by the court to trustees and attorneys, accountants, appraisers, auctioneers and other professionals employed by trustees and to examiners is available for examination by the public. Contact the Clerk's Office to request access to the yearly summary.


Federal Records Center (FRC) Information

To receive information on how to obtain copies in a closed case or adversary located in the Federal Records Center, send your request to the appropriate office.  The clerk's office will provide you with the necessary location number, box number, and accession number that are used by the FRC to locate your case or adversary. The FRC will make photocopies pursuant to the information form that we will send to you.

If you do not have the case or adversary number, refer to and follow the instructions to complete a search of records for the information needed.
