(a) Where to File. Petitions may be filed with the clerk or in any office of the clerk.
(b) Number of Copies. Petitions shall be filed in numbers mandated by chapter within Local Bankruptcy Rule 1007-1 for lists, schedules and statements.
(c) Corporate Resolution/LLC Authority. A voluntary petition filed by a corporation shall be accompanied by a copy of the corporate resolution or other appropriate authorization, duly attested to, authorizing such filing. A voluntary petition filed by a limited liability company shall be accompanied by a copy of the appropriate authorization, duly attested to, authorizing such filing.
(d)
Noncompliance. The failure to comply with the requirements of this rule
may subject the case to dismissal.
Comment
Although FRBP
5005(a)(1) requires the clerk to accept papers for filing which are not
in proper form, subsection (d) of this rule makes clear that the court
may take appropriate action to enforce this rule.
