Rule 1004-1.     Petition - Partnership

          (a)     Partnership Declaration/LLP Authority. A voluntary petition filed by a partnership shall be accompanied by appropriate authorization, duly attested to by all general partners, authorizing such filing. A voluntary petition filed by a limited liability partnership shall be accompanied by a copy of the appropriate authorization, duly attested to, authorizing such filing.

          (b)     Noncompliance. The failure to comply with the requirements of this rule may subject the case to dismissal.
 
 

Comment

          This rule should be read in conjunction with FRBP 1004(a), which permits a voluntary petition to be signed by less than all general partners, if all general partners consent.

          Although FRBP 5005(a)(1) requires the clerk to accept papers for filing which are not in proper form, subsection (b) of this rule makes clear that the court may take appropriate action to enforce this rule.
