Unless otherwise
ordered by the court, the clerk shall not be required to render any service
for which a fee is prescribed, either by statute or by the Judicial Conference
of the United States, including the acceptance of a document for filing,
unless the fee for that service is paid in advance or an order is entered
pursuant to 28 U.S.C. 1915(a) granting in forma pauperis status for an
adversary proceeding or appeal.
Comment
Filing fees for adversary proceedings and appeals are authorized by 28 U.S.C. 1930(b) and set forth in the Judicial Conference Schedule of Fees.
Upon application
and order of the court, adversary proceedings and appeals may be filed
in forma pauperis. As required by 28 U.S.C. 1915(a), a party seeking to
proceed in forma pauperis must file an affidavit: (1) advising that the
person is unable to pay the fee or give security therefor and (2) stating
the nature of the appeal and the affiant's belief as to entitlement to
relief.
