If within any
adversary proceeding, contested matter or action to which neither the United
States nor any agency, officer or employee thereof (other than the United
States trustee) is a party, a party draws into question the constitutionality
of an Act of Congress or any statute of any state affecting the public
interest, that party shall contemporaneously file with the court a separate
statement referencing the existence of such question, giving the full caption
of the case, the adversary proceeding number, if any, a reference to the
questioned statute sufficient for its identification and a concise summary
stating the issues upon which it is claimed that the statute is unconstitutional.
